Competition terms & conditions.
1. All Competition entrants must be over the age of 18.
2. Each purchase will be counted as one entry so participants can enter multiple times.
3. Only customers (new or existing) who purchase a hardware device or a 3 or 12 month subscription will be eligible to enter the IceTV iPad competition. Subscription auto renewal, free trials and one month subscriptions will not be eligible to enter.
4. Entry is open only to Australian residents. Directors, officers, management, employees and other staff (and the immediate families of directors, officers, management, employees and other staff) of IceTV or of its related bodies corporate, or of the agencies or companies associated with this competition are ineligible to enter.
5. The competition will be conducted during the competition period which begins on the 26th May 2010 and ends on the 31st of May 2010.
6. This is a game of skill; chance plays no part in determining the winner/s. Each valid entry will be individually judged by a representative of IceTV based on the entrants answer to our (IceTV) question during the entry process.
* The "question" to validate the entry is "In a 100 words or less explain how IceTV has changed the way you watch TV"
7. The winner will be notified via email.
8. The judges' decisions are final and no correspondence will be entered into.
9. All entries and materials submitted to IceTV in connection with this competition (in any form, including without limitation in hard copy or electronic form), become the property of iceTV and each entrant warrants that it has the right to transfer these things to IceTV. Each entry must be the entrant.s original work. By entering this competition entrants:
* Consent to IceTV publishing your answer to the question on the IceTV website. IceTV will only refer to any answers to the .question. by using the customer.s first name and suburb of residence. No identifiable information will be made public.
10. The prize/s will be awarded to the valid entrant who best meets the judging criteria, as determined by the judges. Entries that, in IceTV.s judgment, contain offensive, defamatory or otherwise objectionable or inappropriate material or that infringe any third party rights will be invalid.
11. The winner has 7 Days upon notification to claim the prize by replying to the email IceTV has sent to notify the entrant has won. Contact details provided when ordering from IceTV (Email) will be used to contact the nominated prize winner. If the selected prize winner does not respond and accept their prize by contacting IceTV staff within 7 days, their entry will be forfeited and another winner will be chosen. The winner of the redraw will also have 7 days to claim their prize and will also be subject to the promotion terms and conditions.
12. The competition may be withdrawn without notice at the discretion of IceTV.
13. IceTV and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person.s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
14. Without limiting the previous paragraph, IceTV and its associated agencies and companies will not be liable for any damage to or delay in transit of prizes. Prizes will be provided by IceTV to the winner/s.
15. If due to any reason whatsoever IceTV becomes aware after an entrant has won a prize that the entrant has not complied with these terms, that entrant will have no entitlement to the prize, even if IceTV has announced them as a winner and that entrant will be required, at the direction of IceTV, to return, refund or otherwise make restitution of the prize.
16. Ice TV may, in its sole discretion, disqualify any or all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these terms, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
17. IceTV has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. IceTV is not liable for any consequences of user error including (without limitation) costs incurred. Any form of automated entry using any device or software is invalid.
